As the WA Representative on the ACCC Small Business and Franchising Consultative Committee, I want to ensure that the Western Australian (WA) Franchising Community has a voice nationally.
BDA is preparing a submission to the ACCC which is due by 4 December 2020 and we seek your feedback, concerns and issues relating to the impact of the proposed changes and your business.
I will give a summary overview of the changes and then we look to formulate your views on:
Are the changes are succinct enough or whether they need more clarification and/or if they are just not suitable as written.

Assignment
The Franchisor will normally retain the rights to interview and accept any proposed buyer and may also retain the rights of buying the franchise back themselves. The outgoing Franchisee has the right to set the price of the franchise. It is normal for an assignment fee to be paid to the Franchisor, who generally utilize those funds to train and induct the new Franchisee.
